CAIGHDEÁN IOMPAIR A LEAGADH SÍOS

 

Cuirtear in iúl i gcaighdeáin Coláiste Ailigh na cineálacha iompair agus caidreamh a chruthóidh timpeallacht dhearfach don teagasc agus don fhoghlaim. Cuireann siad síos ar an iompar a bhfuiltear ag súil leis ó gach ball de phobal na scoile.

 

 

Léiríonn caighdeáin iompair Choláiste Ailigh luachanna mar seo a leanas:

 

  • meas ort féin agus ar dhaoine eile
  • cineáltas agus toilteanas cuidiú le daoine eile
  • cúirtéis agus dea-bhéasaíocht
  • cothroime
  • a bheith ullamh bealaí urramacha a úsáid chun deacrachtaí agus coimhlint a réiteach
  • maithiúnas.

Léiríonn caighdeáin an t-iompar do-ghlactha

 

Ar na bealaí chun fógairt do bhaill an phobail scoile na cineálacha iompair nach bhfuil inghlactha sa scoil is féidir feidhm a bhaint as caighdeáin, mar shampla:

  • iompar a ghortaíonn daoine eile (bulaíocht, ciapadh, leithcheal agus íospairt san áireamh)
  • iompar a chuireann isteach ar theagasc agus ar fhoghlaim
  • bagairtí nó duine eile a ghortú go fisiceach

Standards of Behaviour:

Coláiste Ailigh’s standards of behaviour express the kinds of behaviour and relationships that will create a positive environment for teaching and learning. They describe the behaviour expected of all members of the school community.

 

Coláiste Ailigh’s standards of behaviour reflect values such as:

 

  • Respect for self and others
  • Kindness and willingness to help others
  • Courtesy and good manners
  • Fairness
  • Readiness to use respectful ways of resolving difficulties and conflict
  • Forgiveness

 

The standards describe the commitment that the school expects from students to their own learning and to that of their peers. This commitment includes:

 

  • Attending school regularly and punctually
  • Doing one’s best in class
  • Taking responsibility for one’s work
  • Keeping the rules
  • Helping to create a safe, positive environment
  • Respecting staff
  • Respecting other students and their learning
  • Participating in school activities
  • Showing respect for our language and culture.

 

Standards signal unacceptable behaviour

 

Standards are also a way of signalling to members of the school community the kinds of behaviours that are not acceptable in the school, for example:

  • Behaviour that is hurtful including bullying, harassment, discrimination and victimisation)
  • Behaviour that interferes with teaching and learning
  • Threats or physical hurt to another person
  • Damage to property
  • Theft and Showing disrespect to our language and culture.

RÓIL AGUS FREAGRACHTAÍ/ROLES & RESPONSIBILITIES:

 

An Pátrún/The Patron:

 

Faoi fhorálacha an Achta Oideachais, 1998, tá Pátrún (Bord Oideachais agus Oiliúna, Co Dhún na nGall) ag Coláiste Ailigh, scoil a chuireann feidhmeanna áirithe i gcrích ar an sonrú san Acht.
Under the provisions of the Education Act 1998, Coláiste Ailigh has a Patron, namely, Donegal ETB, who carries out certain functions specified in the Act.

 

Bainistíonn an Bord Bainistíochta an scoil ar son an Phátrúin agus chun leas na mac léinn agus a dtuismitheoirí/caomhnóirí. Ní foláir don Bhord:
The Board of Management manages the school on behalf of the Patron and for the benefit of the students and their parents/guardians/guardians. The Board must:

Ba chóir don Bhord Bainistíochta an cód iompair scoile a chur faoi bhráid an Phátrúin lena fhaomhadh d’fhonn na forálacha seo a chomhlíonadh.
In order to comply with these provisions, the Board of management will submit this code of behaviour to the Patron for approval following this review.

 

An Bord Bainistíochta/The Board of Management:

 

Is é ról foriomlán an Bhoird Bhainistíochta a chinntiú go bhforbraítear cód iompair sa scoil. Mar scoil lán-gaelach, tá ár bhféiniúlacht, éiteas, luachanna agus cultúr féin againn. Tá freagracht ar leith ar an Bhord as éiteas na scoile, chomh maith le freagracht fhoriomlán as polasaithe scoile. Bíonn ról lárnach ag an Bhord sa phróiseas lena bhféachfar ar na cineálacha caidreamh agus iompair a léireoidh an t-éiteas sin.
The overall responsibility for ensuring that a code of behaviour is prepared in the school rests with the Board of management. As an All Irish school, we have a unique identity, ethos, values and culture. The Board has particular responsibility for the ethos of the school, as well as having overall responsibility for school policies. The Board plays an active role in exploring the kinds of relationships and behaviours that will reflect the school’s ethos and responsibilities.

 

Tógann an Bord baill uile na scoile isteach le bheith páirteach san obair ar an chód iompair. Beidh taifead foirmiúil déanta ag an Bhord de ghlacadh leis an chód iompair, maille leis an dáta tosaithe agus cinntí athbhreithnithe maidir le cathain a dhéanfaí athbhreithniú ar an chód.

The Board makes sure that all the members of the school community have the opportunity to be involved in work on the code of behaviour. The Board of Management will formally record the adoption of the code of behaviour, the commencement date and decisions about when the code will be reviewed again.

 

An Príomhoide/The Principal:

 

Tascanna tábhachtacha ceannaireachta is ea forbairt nó athbhreithniú, agus cur i ngníomh an chóid iompair scoile a phleanáil. Beidh an fhreagracht ar an Phríomhoide as obair ar an gcód iompair a stiúradh, faoi threoir an Bhoird.
Leading the audit and review of the code of behaviour, and ensuring that it is implemented in the school, are important leadership tasks. It is the responsibility of the Principal, under the direction of the Board, to lead the work on the code of behaviour.

 

Múinteoirí agus baill fhoirne eile/Teachers and other staff members:

 

Tá ról ríthábhachtach ag múinteoirí in athbhreithniú nó nuashonrú an chóid iompair scoile. Teachers and other staff members play important roles in the work in the review and updating of the code. They bring to this work their professional expertise in understanding the links between behaviour and learning; their experience of what works to help students to behave well; and their knowledge of the school and of the school community.

The parents committee had a positive contribution to the development of our code of behaviour. It will be more likely to work well where parents/guardians/guardians have meaningful ways of contributing to the development of review of the code. Their involvement drew on their expectations, insights and experiences. It will help to underline their responsibilities for their children’s behaviour. Joint work between parents/guardians/guardians and staff in the development of the code of behaviour can:

Our students played a role in putting the code of behaviour together. They are more likely to support a code of behaviour when they have helped to develop it. Relationships of trust between teachers and students can grow stronger through the process. Through their involvement, students:

AN CÓD IOMPAIR

 

Is é atá sa chód iompair ná sraith clár, cleachtas agus nósanna imeachta a chuimsíonn plean na scoile chun cuidiú le mic léinn a bheith deá-iompartha agus foghlaim go maith ar scoil.

Cuidíonn an cód iompair le pobal na scoile éiteas, polasaithe, nósanna imeachta agus cleachtais na scoile a chothú a spreagann deá-iompair agus a choisceann iompar do-ghlactha. Cuidíonn an cód iompair le múinteoirí, agus le baill fhoirne eile, le mic léinn agus le tuismitheoirí/caomhnóirí oibriú lena chéile d’fhonn scoil éifeachtach shlán a bheith ann.

 

Rational/Purpose of Code of Behaviour

 

The code of behaviour helps the school community to promote the school ethos, relationships, policies, procedures and practices that encourage good behaviour and prevent unacceptable behaviour. The code of behaviour helps teachers, other members of staff, students and parents/guardians/guardians to work together for a happy, effective and safe school.

 

RIALACHA SCOILE: COLÁISTE AILIGH

 

  1. Cuireann Coláiste Ailigh oideachas d’ardchaighdeán ar fáil trí mheán na Gaeilge. Creideann sí sa Chultúr Ghaelach, i gcothromaíocht, i luach an duine agus i spiorad an náisiúin.

 

  1. Ba mhian linn a chur in iúl do thuismitheoirí / do chaomhnóirí agus do scoláirí go mbímid ag dréim le caighdeán ard-iompar agus comhoibriú i gColáiste Ailigh.

 

  1. Braitheann an coláiste ar chaighdeán ard iompar agus comhoibriú chun atmaisféar foghlama dearfach a chothú ina ndéantar deá-thréithe, pearsantacht, spioradáltacht, moráltacht agus sibhialtacht an duine a fhorbairt agus a spreagadh.

  1. Coláiste Ailigh is committed to providing a quality educational service through the medium of Irish in partnership with school personnel, students and parents.

 

  1. The philosophy of Coláiste Ailigh is the education of the whole person with a special emphasis on the promotion of the Irish language and culture.

 

  1. The Coláiste recognises, supports and endeavours to accommodate the right to each individual student to learn in an educationally conducive environment and endeavours to ensure that the educational, emotional, spiritual, psychological and moral welfare of each individual student is provided for at all times.

 

  1. To maintain such an atmosphere parents need to be aware that the highest standards of behaviour and cooperation are always expected from our students. To this end, Coláiste Ailigh encourages the cooperation and assistance of parents/guardians of the student.

 

  1. Merit awards and positive notes in the diary andon VSware are used to reward and encourage good behaviour and recognise significant achievement.

 

However, where students’ behaviour becomes unsatisfactory there is a need for sanctions to register disapproval of unacceptable behaviour.

 

CÓD IOMPAIR / CODE OF BEHAVIOUR

 

The code of behaviour is positive in nature and is centred on respect for oneself and the environment. It is developmental and will promote a spirit of self-discipline and integrity.

 

  1. SLÁINTE AGUS FOLLÁINE AN SCOLÁIRE /STUDENT HEALTH AND WELL-BEING

 

  1. Caithfidh gach scoláire éide scoile ceart a bheith orthu gach lá.
    All students attending the school are to wear the designated school uniform.
  2. Caithfidh culaith spóirt iomlán a bheith leat chun na scoile aon lá a bhfuil corpoideachais le bheith agat.
    Students must bring suitable physical education gear with them on days when it is required.
  3. Níl cead fáinní cluaise fada a chaitheamh. Ní cheadaítear ach stodaí cluaise. Níl cead stodaí/fáinní a chaitheamh in áit ar bith eile sa chorp ach amháin sa chluas.
    The wearing of jewellery is confined to stud earrings only.
  4. Má tá gruaig fhada agat, coinnigh ceangailte siar í.
    Hair should be neatly groomed at all times.
  5. Tá cosc iomlán ar bhuidéil Tippex, pinn lasair agus rudaí contúirteacha eile den tsórt.
    Bottles of Tippex, laser pens and any other items likely to cause injury have no place in the school and are strictly forbidden.

      Smoking, the consumption of alcohol and the possession of other illegal substances are all strictly forbidden within the school building, while on the school grounds, while travelling to and from school or while participating in any school activity.

    Chewing gum is strictly forbidden in Coláiste Ailigh.
  2. Ní thabharfaidh aon bhall den fhoireann leigheas d’aon tsórt amach do scoláire ar bith. Is é seo dualgas an scoláire féin agus tuismitheoirí/caomhnóirí.(Acht um Sláinte agus Sábháilteachta)
    In keeping with health and safety regulations, medication of any kind will not be administered by staff and is entirely the responsibility of the student, and his/her parent/guardian.

 

  1. SÁBHÁILTEACHT AN SCOLÁIRE / STUDENT SAFETY

      Students must remain within the school grounds during school hours and may only leave with the prior permission of parents/guardians, of the Principal or other designated persons.

      Notes, signed and dated by a parent/guardian must be written in the following circumstances:

If a student is absent from school.

If a student arrives late to school in the morning.

If a student must leave the school early for an appointment.

If homework is not completed or done properly.

If the student is not wearing the complete school uniform.

      Running is not permitted in the school building.

      Students are not permitted to remain on school premises after school hours except when attending the homework club or another supervised school based activity.

 

 

  • TINREAMH AGUS PONCÚLACHT / ATTENDANCE AND PUNCTUALITY

 

  1. Caithfidh gach scoláire bheith i láthair sa scoil agus réidh don chéad trí rang an mhaidin sin gach maidin roimh 9.00 r.n.

      Students are expected to arrive in school before 9.00am with all necessary books and materials ready for the first three classes in the morning.

 

  1. Ní mór do dhaltaí an clár eolais a sheiceáil achan maidin chun socraithe feitheoireachta don lá a chinntiú (más ann iad), agus dul go seomra ranga an mhúinteora atá i mbun feitheoireachta don mhúinteoir atá as láthair.

 

 

Students must check the notice board each morning to ascertain arrangements in place for any absent teacher, and go to the covering teacher’s classroom during class scheduled with the absent teacher.

      Students must prepare the necessary materials for class when the first bell is sounded at 11.12a.m. and 1.54 p.m. It is not permitted to return to lockers between classes and permission will be refused if sought.

 

  1. Caithfidh gach scoláire bheith i láthair ag an tionóil ag 11.00 r.n. maidin Dé hÁoine.

      All students must be present at assembly at 11.00 a.m. on Friday mornings.

 

  1. Caithfidh scoláire a thagann isteach mall ar aon chúis an leabhar mall a shíniú.

      A student who arrives late to school for any reason must sign the late book.

 

  1. Caithfidh scoláire atá ag fágaint na scoile ar aon chúis síniú amach mar is cóir.

      A student who leaves the school early for any reason must sign out as appropriate.

 

 

iv          IOMPAR GINEARÁLTA / GENERAL BEHAVIOUR

 

  1. Is í an Ghaeilge teanga na scoile. Ní mór do scoláirí an Ghaeilge a úsáid sa scoil i gcónaí.
    Irish is the working language of the school. Students are expected to speak Irish at all times.
  2. Ní mór do scoláirí bheith múinte i gcónaí le foireann na scoile, lena chéile agus le cuairteoirí.
    Good manners, courtesy and respect towards each other, towards other members of the school community, and towards visitors to the school is a central requirement
  3. Ní mór do scoláirí treoir an mhúinteora a ghlacadh i gcónaí. Má iarrtar ort rud éigin réasúnta a dhéanamh, ní mór é a dhéanamh.
    Students are expected to respect and co-operate fully with teachers and other school staff. Students may not refuse to carry out reasonable requests made to them by a teacher or other members of staff.
  4. Níl cead bheith ag ithe nó ag ól sna seomraí ranga. Níl cead bheith ag ithe nó ag ól ach insan chearnóg mhór agus ag na hamanna leagtha síos ag an scoil. Fág gach seomra agus clós na scoile néata agus glan i do dhiaidh.
    Eating is confined to the cearnóg mhór and at designated times only. Students must co-operate in keeping classrooms and school grounds neat and litter free.
  5. Níl cead úsáid a bhaint as ríomhairí scoile nó an idirlíon ach faoi stiúiriú ball den fhoireann teagaisc.
    Access to computers and the internet is allowed only with direct supervision of teaching staff.

 

 

v        MAOIN NA SCOILE AGUS MAOIN PHEARSANTA/

SCHOOL AND PERSONAL PROPERTY

 

  1. Má dhéantar aon damáiste sa scoil tá sé de dhualgas ar an scoláire é seo a chur in iúl do mhúinteoirí láithreach. Ba chóir do scoláirí meas a bheith acu ar mhaoin na scoile, laistigh agus lasmuigh den seomra ranga i gcónaí, agus damáiste ar bith déanta de bharr droch-chúram nó mí-iompar a cheartú.

      If damage is caused to school property accidentally, a teacher must be informed immediately. Students must show respect for school property both in the classrooms and outside and make good any damage to such property caused by neglect or misbehaviour.

  1. Ní ghlacann an scoil aon fhreagracht as maoin an scoláire a bhíonn caillte nó a bhíonn damáiste déanta dí. Dá bhrí sin iarrtar ar thuismitheoirí / caomhnóirí na lipéid cóir a chur ar mhaoin phearsanta an scoláire.

      The school cannot accept responsibility for the loss or damage to students’ property and parents / guardians are advised to ensure that each student’s property be labelled accordingly.

  1. Níl cead ipod, “Apple watch”, raidió phearsanta nó aon rud cosúil leo a bheith tógtha isteach sa scoil.

      The use of ipods, “Apple” watches, personal stereos or any such equipment is forbidden.

  1. Tá cosc iomlán ar fón póca nó ceamara fón sa scoil. Glacfar aon fhón a bhíonn istigh i rith an lae scoile ar shiúl ón scoláire. Coinnítear sa scoil ar feadh dhá oíche é. I gcás go n-úsáideann scoláire ceamara fón le grianghraf nó taifead ar bith eile de scoláire eile nó aon bhall de phobal na scoile a ghlacadh i rith an lae scoile, cuirfear an scoláire ar fionraí.
    Tá eisceacht amháin ar an riail seo, agus is é sin má tá an fón in úsáid istigh sa seomra ranga le haghaidh teagasc agus foghlaim, faoi stiúradh mhúinteora. Ní mór do dhaltaí fón a fhágáil in oifig na scoile roimh agus i ndiaidh an ranga ina bhfuil sé in úsáid acu. Beidh polasaí úsáid inghlactha á forbairt againn i rith na scoilbhliana 2019/20.

 

      Mobile phones are prohibited during school hours. Students who breach this rule will have their phone confiscated for two nights.  Where a student breaches this rule by using a camera phone to take a picture or other recording, either of a fellow student or a staff member, at any stage during the school day, that student will be suspended.

      The one exception to this rule is where the phone is to be used in a particular class in the context of teaching and learning, under the teacher’s direction. The phone must be left in the school office before and after the class in which it is to be used. We will develop an acceptable usage policy during the 2019/20.

      When away on school outings or engaged in extra-curricular activities each student is expected to behave in an exemplary manner, complying with all the directions of the teacher in charge. School rules remain in force. If the school uniform is required, adherence to the full uniform code is expected. Students who bring dishonour to the school, bring dishonour to themselves and to their local community.

Each individual subject teacher is responsible for discipline in his/her class. Minor incidents of misbehaviour may be recorded in the diary by the subject teacher. Serious incidents of misbehaviour may be recorded on Vssware by the Year Head. Parents / guardians are asked to check the diary and VSware at the end of each week.

    If a student receives 8 negatives notes, a written warning is posted in the diary, and student is placed on weekly report.  The student must get the signature of each teacher at the end of class for the duration of weekly report and this is recorded on vsware.

    The Year Head checks that the weekly report has been successfully signed by each teacher, and if so, the student will receive a positive note in the diary and on vsware. If this is not the case, the student will receive a disciplinary card, and this is recorded on vsware.

    If a student receives 12 negative notes, a discipline card is issued and recorded on vsware.

    If a student receives 16 negative notes, a further disciplinary card is issued and recorded on vsware.

    If a student receives 20 negative notes, a further disciplinary card is issued and recorded on vsware.

    When a student has reached 20 notes and/or 3 discipline cards, the student must appear before a disciplinary committee.

    Where a student loses his/her school diary, a second diary must be purchased at a cost of €10.

    A disciplinary card will be issued to a student who does not have his/her diary in class.
  9. Má bhíonn nótaí á dtarraingt amach as an dialann scoile nó má bhíonn an dialann caillte faigheann an rangmhúinteoir tuairisc ó achan mhúinteoir mar gheall ar an dalta agus más gá iarrtar ar na tuismitheoirí/caomhnóirí teacht isteach ag am oiriúnach, chomh luath agus is féidir chun an cás a phlé.

     A report from each individual teacher will be sought by the class teacher of a student who removes notes from his/her school diary or who loses his/her school diary. If necessary a meeting may be arranged by the class teacher with a parent / guardian, at a mutually convenient time, to discuss the situation.

    If a student neglects the Irish language.
  3. Ar chúiseanna tromchúiseacha / cuntais dhiúltacha ar VSware.
    For serious incidents of misbehaviour recorded on VSware.
  4. Nuair a fhágann dalta scoil gan cead
    When a student leaves school without permission.

 

COISTE SMACHTA / BOARD OF DISCIPLINE

 

Cuirfidh an Coiste Smachta an Próiseas Aisiríocha i bhfeidhm/

The Discpline Board will take the restorative approach to dealing with the case.

 

  1. Tar éis 3 chárta smachta a fháil, nó eachtra tromchúiseach, téann an dalta os comhair an choiste smachta. Cuirtear litir abhaile chun seo a chur in iúl do thuismitheoirí / caomhnóirí.

      Having received three discipline cards, or in the event of a serious incident, the student then comes before the Board of Discipline. Correspondence is made with parents/guardians making them aware of this.

 

  1. Beidh deis ag an scoláire a chás/a cás a chur os comhair an choiste smachta agus cuirfidh an coiste moltaí / smachtbhannaí le chéile.

      The student will be given an opportunity to place his/her case in front of the Board of Discipline and the Board will then put forward suggestions as to the best / most appropriate course of action.

      Parents / guardians will have the opportunity to be present at this meeting and correspondence will be made with them accordingly

FIONRAÍ / SUSPENSION

 

An t-údarás mac léinn a chur ar fionraí

 

Tá údarás ag Bord Bainistíochta Coláiste Ailigh dalta a chur ar fionraí. I gcásanna ina

dtarmligean an Bord Bainistíochta an t-údarás seo don Phríomhoide, caithfidh an Bord é seo a dhéanamh go foirmiúil agus i scríbhinn. Bhí an t-údarás tugtha don Phríomhoide ag cruinniú Bord Bainistíochta ar 20 Aibreán 2016.

 

The Board of Management of Coláiste Ailigh has authority to suspend a student.  In cases where the Board of Management delegates this authority to the Principal, the Board must do so formally and in writing.  This authority was given to the Principal at a meeting of the Board of Management on April 20th 2016.

 

Nuair a chuirtear na smachtbhannaí uilig i bhfeidhm, agus má leanann an scoláire ag briseadh an chórais smachta go rialta, cuirfear an scoláire sin ar fionraí. Cuirfear seo in iúl do thuismitheoirí/caomhnóirí ag an phríomhoide. Tá sé de chead ag tuismitheoirí/caomhnóirí achomharc a dhéanamh ar an chinneadh seo.

If and when all procedures have been exhausted unsuccessfully and the student continues to breach the disciplinary code it may be necessary to suspend a student for a period of time. Parents / guardians will be notified of this decision by the Principal, as well as by letter through the post. Parents have the right to appeal this decision.

Certain other specific incidences may occur which also warrant suspension, eg unauthorised absence from school (mitching), mis-use of mobile phone and internet,  smoking on school premises/in school uniform etc.  Parents will be notified in writing of the reason for and duration of suspension.

Suspension during a State examination

This sanction should normally be approved by the Board of Management and should only be used where there is:

  • a threat to good order in the conduct of the examination
  • a threat to the safety of other students and personnel
  • a threat to the right of other students to do their examination in a calm atmosphere.

 

The sanction should be a proportionate response to the behaviour. For example, it would rarely be appropriate for a first offence, unless there is a threat to the good order of the conduct of the examination. This sanction will be treated like any other suspension, and the principles and fair procedures governing suspensions will be applied. The DES Best Practice Guidelines concerning Certificate Examinations offer guidance to schools.

 

 

‘Uathfhionraí’

‘Automatic’ suspension

The Board of Management may decide, as part of the school’s policy on sanctions, and following the consultation process with the Principal, parents, teachers and students, that particular named behaviours incur suspension as a sanction. However, a general decision to impose suspension for named behaviours does not remove the duty to follow due process and fair procedures in each case.

 

 

Nósanna imeachta i ndáil le fionraí láithreach

I gcás go mbreithníonn an Príomhoide gur chóir mac léinn a chur ar fionraí láithreach, ar mhaithe le sábháilteacht an mhic léinn, na foirne nó daoine eile, beidh réamh-imscrúdú reáchtáilte chun cás a bhunú a thacódh leis an fhionraí. Procedures in relation to immediate suspension

 

 

Where an immediate suspension is considered by the Principal to be warranted for reasons of the safety of the student, other students, staff or others, a preliminary investigation will be conducted to establish the case for the imposition of the suspension. The formal investigation will immediately follow the imposition of the suspension. All of the conditions for suspension apply to immediate suspension.

The period of suspension

A student will not be suspended for more than three days, except in exceptional circumstances where the Principal considers that a period of suspension longer than three days is needed in order to achieve a particular objective. If a suspension longer than three days is being proposed by the Principal, the matter should be referred to the Board of Management for consideration and approval, giving the circumstances and the expected outcomes. The Board of Management will place a ceiling of ten days on any one period of suspension imposed by it. The Board will formally review any proposal to suspend a student, where the suspension would bring the number of days for which the student has been suspended in the current school year to twenty days or more. Any such suspension is subject to appeal under section 29 of the Education Act 1998.

Where a suspension period of 6 days or more is imposed by the Principal the EWO will be notified of the suspension. In such a case the Principal will inform the Board of Management of the decision and parents will be informed of their right to appeal.

The Board of Management will offer an opportunity to appeal a Principal’s decision to suspend a student. In the case of decisions to suspend made by the Board of Management an appeals process may be provided by the Donegal ETB.

Section 29 Appeal

 

Where the total number of days for which the student has been suspended in the current school year reaches twenty days, the parents, or a student aged over eighteen years, may appeal the suspension under section 29 of the Education Act 1998, as amended by the Education (Miscellaneous Provisions) Act 2007.

At the time when parents are being formally notified of such a suspension, they and the student will be told about their right to appeal to the Secretary General of the Department of Education and Science under section 29 of the Education Act 1998, and will be given information about how to appeal.

The appeal will be made in the first instance to the ETB. Where an appeal to the ETB is concluded, parents, or a student aged over eighteen years, may appeal to the Secretary General of the Department of Education and Science.

Implementing the suspension

 

Written notification

The Principal should notify the parents and the student in writing of the decision to suspend. The letter should confirm:

 

  • the period of the suspension and the dates on which the suspension will begin and end
  • the reasons for the suspension
  • any study programme to be followed
  • the arrangements for returning to school, including any commitments to be entered into by the student and the parents.
  • the provision for an appeal to the Board of Management
  • the provision for an appeal to the ETB, if appropriate
  • the right to appeal to the Secretary General of the Department of Education and Science (Education Act 1998, section 29).

Records of investigation and decision-making

Formal written records will be kept of:

 

  • the investigation (including notes of all interviews held)
  • the decision-making process
  • the decision and the rationale for the decision
  • the duration of the suspension and any conditions attached to the suspension.

 

Report to the Board of Management

The Principal should report all suspensions to the Board of Management, with the reasons for and the duration of each suspension.

 

Report to NEWB The Principal is required to report suspensions in accordance with the NEWB reporting guidelines (Education (Welfare) Act, 2000, section 21(4)(a)).

The Board of Management will review the use of suspension in the school at regular intervals to ensure that its use is consistent with school policies, that patterns of use are examined to identify factors that may be influencing behaviour in the school and to ensure that use of suspension is appropriate and effective.

Procedures in respect of expulsion

The following procedural steps will be taken:

 

  1. A detailed investigation carried out under the direction of the Principal.
  2. A recommendation to the Board of Management by the Principal.
  3. Consideration by the Board of Management of the Principal’s recommendation; and the holding of a hearing.
  4. Board of Management deliberations and actions following the hearing.
  5. Consultations arranged by the Educational Welfare Officer.
  6. Confirmation of the decision to expel.

 

It is a matter for each Board of Management to decide which of the tasks involved in these procedural steps requires separate meetings and which tasks can be accomplished together in a single meeting, consistent with giving parents/guardians due notice of meetings and a fair and reasonable time to prepare for a Board hearing.

Step 1: A detailed investigation carried out under the direction of the Principal

In investigating an allegation, in line with fair procedures, the Principal should:

 

  • inform the student and their parents/guardians about the details of the alleged misbehaviour, how it will be investigated and that it could result in expulsion
  • give parents/guardians and the student every opportunity to respond to the complaint of serious misbehaviour before a decision is made and before a sanction is imposed.

Step 2: A recommendation to the Board of Management by the Principal

Where the Principal forms a view, based on the investigation of the alleged misbehaviour, that expulsion may be warranted, the Principal makes a recommendation to the Board of Management to consider expulsion. The Principal’s duties:

 

  • inform the parents/guardians and the student that the Board of Management is being asked to consider expulsion
  • ensure that parents/guardians have records of: the allegations against the student; the investigation; and written notice of the grounds on which the Board of Management is being asked to consider expulsion
  • provide the Board of Management with the same comprehensive records as are given to parents/guardians
  • notify the parents/guardians of the date of the hearing by the Board of Management and invite them to that hearing
  • advise the parents/guardians that they can make a written and oral submission to the Board of Management
  • ensure that parents/guardians have enough notice to allow them to prepare for the hearing.

 

Céim 3: Breithniú an Bhoird Bhainistíochta ar mholadh an Phríomhoide agus

Step 3: Consideration by the Board of Management of the Principal’s recommendation; and the holding of a hearing

 

 

It is the responsibility of the Board to review the initial investigation and satisfy itself that the investigation was properly conducted in line with fair procedures. The Board will undertake its own review of all documentation and the circumstances of the case. It will ensure that no party who has had any involvement with the circumstances of the case is part of the Board’s deliberations (for example, a member of the Board who may have made an allegation about the student).

 

Where a Board of Management decides to consider expelling a student, it will hold a hearing. At the hearing, the Principal and the parents/guardians, or a student aged eighteen years or over, put their case to the Board in each other’s presence. Each party will be allowed to question the evidence of the other party directly. The meeting may also be an opportunity for parents/guardians to make their case for lessening the sanction. In the conduct of the hearing, the Board must take care to ensure that they are, and are seen to be, impartial as between the Principal and the student. Parents/guardians may wish to be accompanied at hearings and the Board will facilitate this, in line with good practice and Board procedures.

After both sides have been heard, the Board will ensure that the Principal and parents/guardians are not present for the Board’s deliberations.

Step 4: Board of Management deliberations and actions following the hearing

 

Having heard from all the parties, it is the responsibility of the Board to decide whether or not the allegation is substantiated and, if so, whether or not expulsion is the appropriate sanction. Where the Board of Management, having considered all the facts of the case, is of the opinion that the student should be expelled, the Board must notify the Educational Welfare Officer in writing of its opinion, and the reasons for this opinion. (Education (Welfare) Act 2000, s24(1)). The student cannot be expelled before the passage of twenty school days from the date on which the EWO receives this written notification (Education (Welfare) Act 2000, s24(1)).

Note:

An appeal against an expulsion under section 29 of the Education Act 1998 will automatically succeed if it is shown that the Educational Welfare Officer was not notified in accordance with section 24(1) or that twenty days did not elapse from the time of notification to the Educational Welfare Officer to the implementation of the expulsion (Education (Miscellaneous Provisions) Act 2007, s4A). The Board will inform the parents/guardians in writing about its conclusions and the next steps in the process. Where expulsion is proposed, the parents/guardians will be told that the Board of Management will now inform the Educational Welfare Officer.

Step 5: Consultations arranged by the Educational Welfare Officer

 

Within twenty days of receipt of a notification from a Board of Management of its opinion that a student should be expelled, the Educational Welfare Officer must:

 

  • make all reasonable efforts to hold individual consultations with the Principal, the parents/guardians and the student, and anyone else who may be of assistance
  • convene a meeting of those parties who agree to attend (Education (Welfare) Act 2000, section 24).

 

The purpose of the consultations and the meeting is to ensure that arrangements are made for the student to continue in education. These consultations may result in an agreement about an alternative intervention that would avoid expulsion. However, where the possibility of continuing in the school is not an option, at least in the short term, the consultation should focus on alternative educational possibilities. In the interests of the educational welfare of the student, those concerned should come together with the Educational Welfare Officer to plan for the student’s future education.

 

Pending these consultations about the student’s continued education, a Board of Management will take steps to ensure that good order is maintained and that the safety of students is secured (Education (Welfare) Act 2000, s24(5)). A Board may consider it appropriate to suspend a student 1during this time. Suspension will only be considered where there is a likelihood that the continued presence of the student during this time will seriously disrupt the learning of others, or represent a threat to the safety of other students or staff.

Beidh na tuismitheoirí/caomhnóirí curtha ar an eolas láithreach go bhfuiltear chun dul ar aghaidh leis an díbirt. Inseoidh do thuismitheoirí agus do mhic léinn faoin gceart atá acu chun achomhairc agus foirm chaighdeánach a sholáthar dóibh ar a bhféadfaidís a n-achomharc a thaisceadh. Step 6: Confirmation of the decision to expel

 

Where the twenty-day period following notification to the Educational Welfare Officer has elapsed, and where the Board of Management remains of the view that the student should be expelled, the Board of Management will formally confirm the decision to expel (this task might be delegated to the Chairperson and the Principal). Parents/guardians should be notified immediately that the expulsion will now proceed. Parents/guardians and the student should be told about the right to appeal and supplied with the standard form on which to lodge an appeal. A formal record will be made of the decision to expel the student.

 

Achomhairc

 

Is féidir le tuismitheoir, nó le mac léinn atá níos sine ná ocht mbliana déag d’aois, achomharc a dhéanamh ar an chinneadh díbeartha d’Ard-Rúnaí na Roinne Oideachais agus Scileanna, (faoin Acht Oideachais, 1998, alt 29).

Appeals

A parent, or a student over the age of 18 years, may appeal a decision to expel to the General Secretary of the Department of Education and Skills (under section 29 of the Education Act, 1998).

The appeal must be made in the first instance to the Donegal ETB. Where an appeal to the ETB has been concluded, parents/guardians, or a student aged over eighteen years, may go on to appeal to the Secretary General of the Department of Education and Skills.

The appeals process

The appeals process under section 29 of the Education Act 1998 begins with the provision of mediation by a mediator nominated by the Appeals Committee (Department of Education and Science). For further details about the Appeals process, including requirements for documentation, and the steps in the process, refer to current DES guidance.

 

Athbhreithniú ar úsáid díbeartha

 

Déanfaidh an Bord Bainistíochta athbhreithniú ar úsáid díbeartha sa scoil ar bhonn rialta chun a chinntiú go bhfuil a húsáid i gcomhréir le polasaithe na scoile, go ndéanfar pátrúin úsáide a scrúdú chun gnéithe a shainaithint a d’fhéadfadh a bheith ag imirt tionchair ar iompar sa scoil agus a chinntiú go n-úsáidtear díbirt go hiomchuí.

 

Review of use of expulsion

 

The Board of Management will review the use of expulsion in the school at regular intervals to ensure that its use is consistent with school policies, that patterns of use are examined to identify factors that may be influencing behaviour in the school, and to ensure that expulsion is used appropriately.

 

Procedures in cases of Expulsion

 

  • The student will be withdrawn from class immediately
  • Parents/guardians/Guardians will be notified in writing/or by telephone, informing and advising them of the Principal’s recommendation for expulsion.
  • Parents/guardians/Guardians may present a case to the Principal by meeting him/her. Following such a meeting, the Principal will inform them of his/her decision/recommendation.
  • If an expulsion is recommended by the Principal, the Board of Management will meet to make a decision on the matter.
  • Parents/guardians/Guardians will be informed of their rights to present a case to the Board of Management before a decision is reached.
  • Parents/guardians/Guardians may appeal the decision of the Board of Management to a Sub-Committee of the County Donegal ETB within 7 days of the Board of Management meeting at which the case had been heard.

 

Policies & Procedures for Suspension and Expulsion:

 

The Board of Management at the school has formally delegated to the Principal the authority to suspend a student. This authority is devolved under section 31 of the Vocational Education (Amendment) Act 2001 by the ETB to the Board of Management of a school. Suspension or possible expulsion will be applied, following an enquiry by the Principal, a staff member or disciplinary council delegated by him/her to do so.

In relation to all investigations the following principles and procedures will apply:

 

  • Timelines
  • Confidentiality
  • The right to be heard
  • The right to impartiality
  • The right to appeal

 

Procedures in cases of immediate suspension

 

  • The student will be withdrawn from his/her class immediately but kept under constant supervision
  • The Parents/guardians/Guardians will be notified in writing and by telephone  informing them of the problem and duration of the suspension
  • The Parents/guardians/Guardians may present a case to the Principal by meeting him/her. Following such a meeting, the Principal will review the case and inform the Parents/guardians/Guardians of his/her decision
  • If a suspension of more than 3 days is to be applied, the Board of Management, through the chairman will be informed.
  • The Parents/guardians/Guardians may appeal the decision of the principal to the Board of Management where they may present a case to the Board.
  • If the Board of Management upholds the decision of the Principal, the Parents/guardians/Guardians may appeal the case to a Sub-Committee of the County Donegal Vocational Education Committee within 7 days of the Board of Management meeting at which the case had been heard.
  • Parents/guardians/Guardians together with the offending student must meet with the Principal or his/her representatives before the student is re-admitted to the school.
  • Students who have been suspended for behaviour related offences will not be permitted to represent the school in any capacity during the school year.
  • Any work in preparation for State examinations, missed through suspension, is the responsibility of the student.
